If you are hurt as a result of someone else’s negligence, there are some deadlines that you must be aware of. If you don’t meet these deadlines, you might lose the right to continue with your case.
The statute of limitations in New York State is typically two years for wrongful death cases and three years for negligence cases. There are, however, some circumstances in which that statute is relaxed. For instance, the statute of limitations is lowered to one year and 90 days if a municipality or other governmental body brought on your injury. Additionally, you must submit a notice of claim within 90 days of the accident.
If you don’t follow these guidelines, your claim will be time-barred, which means you can’t seek compensation.
When you are dealing with a shortened statute of limitations, it’s not always obvious. So it’s best to get in touch with a skilled Personal Injury Attorney In Ronkonkoma right away.
Always go to the doctor if you have any injuries. Verify your physical well-being. Also, take care to note all of your pain, even minor ones. Sometimes those minor, bothersome injuries end up being the most serious, long-lasting, and frequently necessitate surgery. If those kinds of injuries are documented right away, it will always help your case.
Record videos and photos. Suppose the party at fault tries to fabricate how your accident occurred or an insurance company attorney tries to argue that you weren’t seriously injured, having documentation of the accident scene. In that case, the damage to your property, and your injuries may prove to be very helpful.
Don’t talk to insurance company investigators. After an accident, the at-fault party’s insurance company will frequently contact you to request information. Being cooperative with these investigators is never a good idea. No matter how amiable they are, you should never forget that their primary objective is to reduce the amount of money they cost their insurance company. One way they accomplish this is by taking advantage of the knowledge you give them. Therefore, it’s best to avoid talking to them. Remember that you are under no obligation under the law to assist them in their investigation.
